These Terms & Conditions ("Terms") govern access to and use of the Property Fusion website, mobile experiences, applications and related services (collectively, the "Platform"), provided by Property Fusion ("Property Fusion", "we", "us", "our"). By creating an account, accessing the Platform, or otherwise using any feature, you agree to these Terms and to our Privacy Policy and Refund Policy.
1. Platform overview
Property Fusion is a South African proptech platform that provides:
- Property management — properties, units, leases, tenants, financials and reporting.
- Property listing — public listings, viewing requests and tenant matching.
- Communication — messaging between landlords, agents, tenants and service providers.
- Maintenance coordination — request intake, provider matching, quoting, completion and payment.
- Payment facilitation — invoicing, rent collection, subscriptions and provider payouts via approved third-party processors.
Property Fusion does not own, let, manage or insure any of the properties listed on the Platform and is not a party to any lease, sale or service contract concluded between users. We act as a technology platform that facilitates interactions between users.
2. Definitions & user roles
- Landlord — a natural or juristic person who owns, lets or controls residential or commercial property and uses the Platform to manage it.
- Agent — a person or agency authorised by a landlord to manage properties, listings or tenants on the landlord's behalf.
- Tenant — a person who applies for, signs or holds a lease for a unit listed on the Platform, including student tenants funded by NSFAS or bursaries.
- Service Provider — an independent contractor (e.g. plumber, electrician, locksmith) onboarded to receive maintenance jobs through the Platform.
- Admin — Property Fusion personnel with elevated rights to verify users, moderate content, support payments and resolve disputes.
- User — any of the above.
3. Account registration & security
- You must be at least 18 years old (or the age of majority in your jurisdiction). If using the Platform for an organisation, you warrant that you have authority to bind it.
- You agree to provide accurate, current and complete information and to keep it updated, including identity, contact, ownership, banking and verification details.
- You are responsible for safeguarding your password, MFA factors and any session cookies, and for all activity under your account.
- We may require verification of identity, ownership of property, banking details or service-provider credentials before enabling certain features.
- We may suspend, restrict or terminate accounts that we reasonably believe are fraudulent, abusive, in breach of these Terms or a security risk.
4. Property listings
- Landlords and agents are solely responsible for the accuracy, lawfulness and completeness of their listings, including price, availability, photos, descriptions, amenities and house rules.
- Misleading, deceptive, discriminatory or unlawful listings are prohibited.
- We may moderate, edit, hide, reject or remove listings or images that are low quality, unrelated, watermarked, AI-misrepresented, infringing or otherwise non-compliant.
- Listings remain in draft until you publish them. You are responsible for content from the moment it is published.
- We may add badges, trust signals or AI-generated suggestions to enhance listings; these do not constitute endorsement.
5. Leases & rentals
- The Platform supports lease creation, digital signing, deposit and rent collection, monthly invoicing, additional cost installments and lease termination workflows.
- Lease agreements are concluded between the landlord and the tenant. Property Fusion is not a party to any lease and does not provide legal advice.
- A lease becomes active once both parties have signed and any required deposit and first month's rent have been recorded as paid (or the deposit has been waived by the landlord).
- Deposits are held by the landlord (not by Property Fusion) and must be administered in accordance with applicable law.
- Student tenants may use NSFAS, bursary or other funding flows. Verification of funding is the landlord's responsibility; Property Fusion provides tooling but no guarantee.
- Termination, notice periods, inspections and final settlements follow the workflows in the Platform; outcomes remain governed by the lease and applicable law.
6. Payments & subscriptions
- Subscriptions to Property Fusion are processed by Paddle.com, our Merchant of Record. Paddle handles checkout, billing, taxes and invoicing on our behalf. The mechanics of payment, billing, taxes, cancellations and refunds are governed by Paddle's Checkout Buyer Terms.
- Tenant rent and lease-related payments may be processed via Ozow or other approved South African processors. Funds settle to the landlord's nominated bank account; we do not hold tenant funds in trust.
- Provider payouts follow completion verification by the landlord and, where applicable, the tenant. We may withhold payouts pending dispute resolution or fraud checks.
- Subscription fees may be charged monthly or annually based on the plan you select. Plan limits and features may change with reasonable notice.
- Failed or cancelled payments may result in suspension of paid features. We are not liable for charges, fees or penalties imposed by your bank or card issuer.
- Refunds are handled in accordance with our Refund Policy, including a 30-day money-back guarantee on subscriptions.
- Our order process for subscriptions is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
7. Service providers
- Service providers operate as independent contractors, not employees or agents of Property Fusion.
- Onboarding may include identity, qualification, insurance and banking verification. Approval is at our sole discretion.
- Jobs may be allocated through queue-based, location-based or rating-weighted matching ("Uber-style"). We do not guarantee a minimum volume of jobs.
- Ratings and reviews submitted by landlords and tenants must be genuine. We may remove ratings that are abusive, manipulative or unlawful.
- Providers are responsible for the quality, safety and lawfulness of the work they perform and for any damage caused by their conduct.
- Provider payouts are subject to verification of completion, invoice accuracy and banking details.
8. Maintenance coordination
- Tenants log requests; landlords approve scope and pricing; providers carry out the work; tenants confirm resolution.
- Property Fusion facilitates coordination only. We do not warrant the workmanship, materials or timing of any provider.
- Emergency situations (gas leaks, fire, structural risk, electrical hazard) must be reported to relevant authorities and not relied on solely through the Platform.
9. User content
- You retain ownership of content you upload — documents, images, messages, videos, reviews, listings.
- You grant Property Fusion a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and display this content solely to operate, secure and improve the Platform and provide it to the intended counterparties.
- You warrant that you have the rights necessary to upload your content and that it does not infringe any third party's rights or applicable law.
- We may use de-identified, aggregated data derived from Platform usage for analytics, benchmarking and product improvement.
10. Prohibited use
You agree not to:
- commit fraud, including fake listings, phantom tenants or fabricated proof of payment;
- impersonate any person, entity or role on the Platform;
- misuse payment flows, perform chargeback abuse, or attempt to launder funds;
- send spam, harassing, abusive or discriminatory messages;
- upload malware, scrape the Platform, probe security, or interfere with its operation;
- infringe any intellectual property, privacy or publicity right;
- use the Platform for any unlawful purpose, including breaches of POPIA, the Consumer Protection Act, the Rental Housing Act or the Estate Agency Affairs Act.
11. Suspension & termination
- We may suspend, restrict, downgrade or terminate access for material breach, non-payment, security or fraud risk, repeated policy violations, or where required by law.
- You may stop using the Platform at any time and cancel your subscription from your billing settings.
- On termination, your right to use the Platform ends. Where practical, we will give you a reasonable opportunity to export your data before deletion, subject to legal retention obligations.
12. Intellectual property
The Platform, including all software, designs, branding, trademarks, content and documentation provided by us, is owned by Property Fusion or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Platform in accordance with your subscription plan and these Terms. No other rights are granted by implication.
13. Disclaimers & liability
- The Platform is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose and non-infringement.
- We are a technology facilitator and are not liable for disputes between users (e.g. between landlord and tenant, or landlord and service provider), the condition of any property, the conduct of any user, or losses arising from third-party services (including payment processors, banks and government systems).
- To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Platform is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim.
- We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill or business opportunity.
- Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, gross negligence or personal injury caused by negligence).
14. Indemnity
You agree to indemnify and hold Property Fusion, its directors, employees and agents harmless against any claim, loss or expense arising from your content, your use of the Platform in breach of these Terms, your conduct toward other users, or your violation of applicable law.
15. Governing law & disputes
These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Platform, subject to mandatory consumer protection rights you may have where you reside.
16. Changes to these Terms
We may update these Terms from time to time. The current version, effective date and version number are shown at the top of this page. Material changes will be communicated through the Platform or by email at least 14 days before they take effect (unless a shorter period is required by law). Continued use after the effective date constitutes acceptance.
